Plant protection products – update of CLP regulation

An amendment to the Regulation CLP has been issued in the EU Journal on August 11th 2020 – namely, Regulation (EU) 2020/1182 amending Table 3 of Annex IV ‘List of harmonised classification and labelling of hazardous substances’. 


New regulation shall apply from 1 March 2022.
By way of derogation from the second paragraph of this Article 2, substances and mixtures may, before 1 March 2022 be classified, labelled and packaged in accordance with Regulation (EC) No 1272/2008 as amended by this Regulation.

Amendment to the CLP regulation – Regulation (EU) 2020/1182 reflects on RAC ECHA opinions formulated from March to November 2018.

Summarized amendment:

● 39 substances were added to the list,
● 21 substances were update (often an acute oral/inhalation ATE of a substance appended),|
● 2 entries were canceled (hexatriacontane, hexyl-2-[4-(diethylamino)-2- hydroxybenzoyl]benzoate).

Moreover, 10 active substances used in plant protection products (PPPs) are newly listed within Annex IV while already listed active substances (used in PPPs)  were changed or appended.

Newly listed active substances used in PPPs (the list may not be complete):
ipconazole
(CAS 125225-28-7, 115850-69-6, 115937-89-8) – ipconazole is among other classified Repr. 1B, H360D; there are several PPPs on the Czech market with this active substance,
paclobutrazol (CAS 76738-62-0),
MCPA-thioethyl (CAS 25319-90-8),
thiencarbazone-methyl (CAS 317815-83-1),
mefentrifluconazole (CAS 1417782-03-6),
flurochloridone (CAS 61213-25-0) – flurochloridone is among other classified Repr. 1B, H360D; there is one PPP on the Czech market with this active substance,
oxathiapiprolin (CAS 1003318-67-9),
fluxapyroxad (CAS 907204-31-3),
penflufen (CAS 494793-67-8),
iprovalicarb (CAS 140923-17-7),
silthiofam (CAS 175217-20-6).

A summary of amended listings of some of the PPPs’ active substances already listed in Annex IV (the list may not be complete):
pirimiphos-methyl (CAS 29232-93-7),
phosphine (CAS 7803-51-2),
tribenuron-methyl (CAS 101200-48-0),
azoxystrobin (CAS 131860-33-8),
ethofumesate (CAS 26225-79-6),
mesotrione (CAS 104206-82-8),
hymexazol (CAS 10004-44-1),
hexythiazox (CAS 78587-05-0).

It is crucial that the applicants revise all PPPs’ assessments with above-mentioned active substances (either changed or newly listed within said amendment of Annex IV).

Should there be any changes in the classification of PPPs as a result of the revised assessment, it is necessary to apply for a change in classification. Moreover, it is necessary to consider eventual changes in personal protection measures.
